Our Aim

We aim to offer our customers quality swimming lessons at a fair cost.  As a start, we hope it is helpful to you to set out the basis on which we will provide our services.

Enrolment and Payment

By signing the Swimming Booking Form, you agree to enrol your child in swimming lessons with Swim with Jo in accordance with these Terms and Conditions.

Payment will be made at the end of every term to secure your place for the following term, by the given date.

Teaching

Whilst it is our policy that we endeavour to ensure you always have the same teacher, we cannot guarantee this and reserve the right to replace swimming teachers if necessary.  Should this occur, refunds will not be given.

Due to the extremely thorough nature of our training, we may occasionally need to have a new instructor teaching your class.  They are always trained at this point but need to teach a series of ‘live classes’ in order to complete their assessment process.  We cannot give advance warning when this may happen and whilst we try to limit it, it is a necessary part of our commitment to quality.

Customers accept that at times there will be physical contact between the teacher and their child in a professional, caring manner and by signing these Terms and Conditions consent to such physical contact as is reasonable.

Your Obligations

Swimming teachers are only responsible for pupils during their lesson and parents/guardians are responsible at all other times including before the lessons, trips to the toilet and other such events throughout the lessons and from immediately after the lesson finishes.

Parents/guardians must refrain from distracting the swimming teachers during lessons. If you would like to discuss your child’s progress, please wait until after the lesson has finished.

Parents/guardians must remain on the premises whilst the pupil is attending their swimming lesson.  This is imperative in the case of the unlikely event of a medical emergency, building evacuation or any other such event.  Pupils must be collected immediately after the lesson has finished.

Parents/guardians and pupils are expected to behave in a civilised manner towards the teacher and other customers and are not expected to use foul language and/or unacceptable or abusive behaviour at any time.  If any individual (parent/guardian or child) behaves inappropriately or in an unacceptable way, we reserve the right to cancel the child’s course without a refund.

While you are waiting for a lesson, please keep poolside noise down to a minimum so that all lessons can take place in a calm and peaceful atmosphere.

All personal items must be taken home at the end of the lesson and the bins provided must be used for swim nappies and all other waste products.

Eating and drinking is not allowed on the poolside or in the changing rooms apart from water.

Children under 4 years of age must adhere to the Happy Nappy ‘double layer’ system.  A baby warmer and swim nappy is not adequate.

No outer footwear or prams should be taken onto poolside or into changing rooms.  Please use overshoes or go barefoot.

All customers should arrange to arrive no more than 15 minutes before the lesson and leave no more than 15 minutes after the lesson to help improve changing room comfort.

All swimmers should attend lessons in appropriate swimwear, with a swim hat and without jewellery.  If a swimmer attends without appropriate swimwear, we reserve the right to turn the swimmer away.

Your Health and Safety Obligations

All medical conditions of parent/guardian and child must be disclosed to us and kept updated.

Do not allow your child or encourage your child to enter the water until you are invited by the teacher to do so.  No swimmers should enter the pool until the teacher says that it is safe to do so and should advise the teacher if they are leaving the pool at any point before the end of the lesson.  If you do not comply with the above, we will not be held responsible or liable for any injury or incident that occurs to your child or yourself.

Please do not bring your baby or child to a lesson if they have been unwell with sickness or diarrhoea within the previous 48 hours of the swim lesson.  For all contagious illnesses, please contact us before the lesson.

Do not run by the pool side and always adhere to the pool rules at each of the venues we swim at.  Should you break any pool rules, we will not be liable for any injury or incident that occurs.

Do not eat for a minimum of 1 hour prior to the lesson if you are to be swimming and do not allow your child to eat for the same amount of time.  Make sure your child goes to the toilet before entering the pool.

One adult must enter the water with each baby/toddler up to the age of 3 years. This adult is exclusively responsible for the safety of the baby/toddler during the lesson.  Immediately before and after the lesson and at all times apart from during the lesson, parents/guardians are responsible for their children as is stated in Clause 3(a). Siblings of children in the class who are under the age of 16 should be accompanied by an additional adult on poolside.

Refund Policy

Missed lessons cannot be refunded or transferred in any circumstance.

No refund will be given in vomit or faeces is discovered in the pool that then forces a pool closure

We are under no obligation to refund lessons that may be missed by local adverse weather when the venue and environs are safe and accessible, and lessons are held. We regret that we are unable to offer automatic refunding or rescheduling of lessons in the event of adverse conditions local to yourselves preventing you from attending a scheduled class.

We reserve the right to change lesson times and venues, and in some circumstances to cancel classes.  Only if an alternative class is not given, will a refund be issued.

Our Liability

We, and the pool facility, will not be liable for any loss, damage or injury suffered on the pool premises except in the case of death or personal injury arising as a result of negligence, lack of due diligence, breach of duty or any other circumstances where liability cannot be excluded by law.

Other than in the exceptions set out in Clause 6(a) above, your participation, that of your spouse/partner, child or those in whose care you have placed your child at the swimming lesson is done so at entirely your and their own risk.

Child Protection and Welfare

We, and the pool facility, will not be liable for any loss, damage or injury suffered on the pool premises except in the case of death or personal injury arising as a result of negligence, lack of due diligence, breach of duty or any other circumstances where liability cannot be excluded by law.

Other than in the exceptions set out in Clause 6(a) above, your participation, that of your spouse/partner, child or those in whose care you have placed your child at the swimming lesson is done so at entirely your and their own risk.
